Products and services rendered by Versabar Tools, LLC ("VBT") are sold under the Terms & Conditions stated herein. No agent or representative is authorized to alter these conditions; any variance thereof must be made in writing and signed by an authorized VBT representative. These Terms and Conditions are subject to change without notice.

 

VERSABAR^® PRICING

• Pricing for Versabar^® products, retrofits and repairs is per Price Supplement effective at time order placed.
• Published prices are subject to change without notice.

 

GUARANTEED TRIAL ORDERS (GTO)

• The GTO Questionnaire must be completed and faxed (or emailed) to VBT.
• VBT must approve the trial by signing and returning the questionnaire to Distributor.
• The completed questionnaire must accompany Distributor purchase order.
• The letters "GTO" must be included on Distributor's purchase order.

SHIPPING

• All shipments are F.O.B. Dickinson, Texas. Unless otherwise advised, the freight charge (including insurance) will be prepaid and added to customer invoice. Title of ownership passes to customer upon delivery from VBT to carrier.
• All Versabar^® products (including shank retrofit/repair) will be insured for value of the invoice.
• Claims for damaged or lost shipments will be made by the Distributor. VBT must be notified of such claims withing three (3) days after receipt. The damaged good containers should be maintained for carrier inspection.

 

CLAIMS

• Any claims for discrepancies in shipment must be made to VBT immediately upon receipt of merchandise.
• VBT shall not be liable to buyer or any other person for special, indirect, incidental, consequential or exemplary losses, damages or expenses, directly or indirectly arising from the sale, handling or use of the products or services from any other cause relating thereto.

 

RETURN & CANCELLATION POLICY

VBT will accept the return of any standard Versabar^® item, subject to the following conditions:

• The item must be unused and in the original package (exception tools approved for GTO).
• An RMA number must be issued and accompany the returned items.
• The item is subject to the inspection of VBT.
• If the reason for the return is the fault of VBT, the restocking charge will be waived.
• All other returns are subject to a 15% restocking charge.
• Special items (non-standard) are non-returnable.
• The value of the item returned will be based upon current pricing.
• The amount of the return will be credited to Distributor's account.

 

PAYMENT TERMS

• All major credit cards are accepted. Charges to credit cards will be made by VBT on day of shipment.
• Terms for accounts with approved credit are 1% 10 days, net 30 days. The amount of credit extended is as agreed based upon credit rating and projected need.
• Should the invoice value for any order ready for shipment cause the account to exceed its available credit, shipment will be suspended pending resolution. In such case, payment terms apply to the date of invoice, not date of receipt.
• Accounts with outstanding invoices thirty (30) days past due are placed on credit hold pending resolution. Work on any special items will be suspended until the account is brought current.

 

WARRANTY

VBT guarantees that Versabar^® products are free from defects in material and workmanship. VBT makes no specific guarantee of performance. VBT's sole obligation is limited to replacing the defective item. VBT is not responsible for any consequential loss resulting from loss of production. The warranty does not apply when:

• The tool has been subjected to misuse, negligence or accident.
• The tool was not fixed, mounted, or stabilized on the machine in accordance with accepted practice.
• The tool was subjected to more severe conditions than recommended for the particular tool.
• The tool was altered in any way so as to, in VBT's opinion, affect its stability or reliability.

 

SAFETY WARNING

Grinding produces hazardous dust. To avoid adverse health effects, use adequate ventilation and read material safety data sheet first. Cemented carbide tools and shanks, ceramic cutting tips and cutting inserts may chip or fragment in use. Always use machine guards, protective clothing and safety glasses to prevent burns or other injury to body or eyes from flying particles or chips.
